Terms of Use — HarborMint

These Terms of Use constitute a legally binding agreement between you and Ethio American LLC ("Company," "we," "us") governing your access to and use of the HarborMint platform at harbormint.co.com. Read these terms carefully before using any part of our services. If you do not agree, do not access or use our services.

A. Eligibility and Account Registration

To use HarborMint services, you must meet all of the following conditions:

You must be at least 18 years of age
You must be a legal resident or citizen of the United States
You must reside in a US state where our services are available (services are not available in all states)
You must successfully complete our identity verification (KYC) process
You must not be prohibited from receiving financial services under any applicable law
You must not appear on any US government sanctions list, including OFAC SDN lists

You agree to provide accurate, complete, and current information during registration and to update that information promptly if it changes. Providing false information is grounds for immediate account termination and may constitute a federal offense.

Each individual may hold only one account. Corporate or business accounts are not currently offered. Accounts are non-transferable.

B. Description of Services

HarborMint provides the following services to eligible verified customers:

Purchase and sale of Bitcoin (BTC) and Ethereum (ETH)
Custodial software wallet accounts for BTC and ETH
Conversion of supported cryptocurrency to US dollars (USD)

HarborMint does not provide investment advice, financial planning services, tax advice, or portfolio management. Nothing on the HarborMint platform constitutes a recommendation to buy, sell, or hold any cryptocurrency or other financial instrument. All transactions are executed at your sole discretion.

Services may be modified, suspended, or discontinued at any time. We will make reasonable efforts to notify users of material changes, but we are not obligated to maintain any specific service offering indefinitely.

C. Fees and Pricing

All fees applicable to your transactions will be disclosed to you before you confirm any transaction. You will have an opportunity to review the total cost, including all applicable fees, before completing a transaction. By confirming a transaction, you agree to the fees shown.

Fee categories may include exchange fees, network fees, conversion fees, and wallet service fees as applicable. The specific amounts vary and are shown in the transaction confirmation flow. HarborMint does not charge fees that are not disclosed prior to confirmation.

Blockchain network fees (such as Ethereum gas fees or Bitcoin miner fees) are determined by network conditions outside HarborMint's control. These are passed through to customers at cost and may fluctuate.

We reserve the right to adjust our fee schedule. Updated fees apply to transactions initiated after the effective date of any change. Fee schedule updates will be posted on the Crypto Exchange page.

D. Risk Disclosure

Cryptocurrency involves substantial risk of loss. You should only engage in cryptocurrency transactions with funds you can afford to lose. By using HarborMint, you acknowledge and accept the following risks:

Market Risk: The value of Bitcoin, Ethereum, and other cryptocurrencies can fluctuate dramatically in short periods. Past price performance does not predict future results.
Regulatory Risk: The legal and regulatory environment for cryptocurrency is evolving. Changes in law could affect the availability or legality of certain services.
Technology Risk: Blockchain networks and software systems can experience outages, bugs, or security vulnerabilities. HarborMint cannot guarantee uninterrupted service.
Custodial Risk: As a custodial wallet provider, HarborMint holds private keys on your behalf. While we maintain security controls, custodial arrangements carry inherent risks distinct from self-custody.
Liquidity Risk: Under certain market conditions, we may be unable to execute transactions at requested times or prices.

Cryptocurrency held through HarborMint is NOT FDIC insured and is NOT bank guaranteed. This is not investment advice.

At a glance: You must not use HarborMint for illegal purposes. Compliance with AML/KYC is mandatory.

E. Prohibited Conduct

You agree not to use HarborMint for any purpose that is unlawful or prohibited by these Terms. Prohibited conduct includes but is not limited to:

Using the platform to engage in money laundering, fraud, or any other financial crime
Providing false or misleading information during registration or KYC verification
Attempting to create multiple accounts or circumvent account restrictions
Using the platform to process transactions on behalf of third parties without disclosure
Attempting to reverse engineer, disassemble, or interfere with platform systems
Violating any applicable US federal, state, or local law or regulation
Engaging in any activity that could damage, disable, or impair the platform

Violations may result in immediate account suspension, termination, asset freezing, and referral to law enforcement. We cooperate fully with law enforcement investigations.

F. Limitation of Liability and Governing Law

To the fullest extent permitted by applicable law, Ethio American LLC, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of HarborMint services, including but not limited to losses resulting from cryptocurrency market movements, service interruptions, or unauthorized account access.

Our total liability to you for any claim arising from use of the platform shall not exceed the fees you paid to HarborMint in the three months preceding the claim.

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in DuPage County, Illinois. You consent to the jurisdiction of those courts.

Nothing in these Terms limits rights you may have under applicable consumer protection laws. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.

G. Account Termination and Error Resolution

You may close your account at any time by contacting us at support@harbormint.co.com. Account closure does not relieve you of obligations incurred prior to closure. Certain records will be retained as required by law regardless of account status.

We reserve the right to suspend or terminate accounts that violate these Terms, fail ongoing KYC review, or present unacceptable compliance risk. Where permitted by law, we will provide notice of account actions.

If you believe an error has occurred in your account or a transaction, you must notify us in writing at support@harbormint.co.com within 30 days of the date the error occurred. Include your account information, a description of the suspected error, and the transaction amount. We will investigate and respond within a reasonable time frame.
